Terms and Conditions

Interpretation

You / User – A person who logs in to the website or/and places an order.

While using the website,

• You acknowledge that you are over the age of 18 years or visit the website in the presence of a parent or a legal guardian, in full compliance with the rules prescribed by the applicable Laws of Georgia or other country;
• You agree that the present Terms and Conditions constitute a legally binding contract by and between the User/Buyer of the Products/Services and the Provider of the Goods/Services;
• You accept the terms of use of the website;
• You approve that you will provide us with complete and accurate information;

 

1. Administrator

Website – Spacefarm.ge is managed by “Adjara Group” (address: No.14, Kostava Str., Tbilisi 0108, Georgia).

 

2. Instructions for placing and receiving an order

An order may be placed on the website in two ways: in the form of single and monthly subscription. 

 

2.1. Single order

Single order may be placed without registration. The user will receive the order confirmed by bank transfer at the address of Farm (No.14, M. Kostava Str., Tbilisi) no later than the second day after confirmation of payment. In case the user is not able to pick up the order on the next day, he/she is obliged to contact Farm at the contact number and agree on the order pickup date, which should not be more than 3 (three) calendar days after confirmation of the order. In case of overdue pickup, the user will receive the order considering normal wear and tear.

After expiration of above 3-day period, Farm is entitled to cancel the order. The amount paid is not refundable.

The parties are authorized to agree on delivery of the order to the user’s address. In this case, the user will have to pay the transportation cost (in the amount of 5 GEL).

Note: If the user wishes to make a non-standard order (different from the offers posted on the website), the user and Farm will agree on the time and conditions of delivery.

 

2.2 Monthly subscription

Subscribers may become the members of Farm and pay the cost of the box on monthly basis.

Subscribers can choose the standard number of boxes to be received during a month: at least 1 per month, 2 per month and at most 3 deliveries. 

 

Log-in

In order to make a monthly subscription, you have to log in to the website and indicate the accurate information:

• Full name
• Personal number
• E-mail 
• Contact phone
• Accurate actual address where the order should be delivered.

If the number of subscribers reaches the maximum, subsequent applicants will be placed on a waiting list. In case of cancellation of subscription by any user, his/her place will be taken by the person on the list, in sequence.

 

Delivery

Delivery will be made only in Tbilisi and its surroundings (Kiketi, Okrokana, Shindisi, Tsavkisi, Tabakhmela, Tskneti, Kojori).

Delivery starts in the second month after registration of subscription and charging.

In case of monthly subscription, the box will be delivered to the user from 09:00 a.m. to 06:00 p.m. in the following days of the month:

• In case of subscription once a month – on the 1st-2nd day of the month;
• In case of subscription twice a month – on the 10th-11th and 20th-21st day of the month;
• In case of subscription three times a month – on the 01st-02nd, 10th-11th and 20th-21st day of the month;

*In case above mentioned dates coincide with Saturday or Sunday products will be delivered by a courier on Friday or on Monday.

The user is obliged to notify Farm no later than 1 (one) calendar day before the delivery date (unless this period can be complied), if he/she is unable to receive the order. With or without compliance with the notification rule, the user will be able to receive the undelivered order in person from the address of Farm, no later than 5 (five) calendar days from the delivery date. After expiration of this period, Farm will no longer have the obligation to deliver the undelivered order to the user. Consequently, the cost of this order is not refundable.

In case of overdue pickup, the user will receive the order considering the normal tear and wear.

 

Delivery of defective product

Farm shall assume responsibility and therefore the obligation to replace the product only if the product turns out to be defective at the moment of its delivery to the user by the courier. Accordingly, the user is obliged to check the quality of the product at the moment of delivery and to apply to Farm by contact e-mail/phone number and send a photo/video material confirming the defect no later than 1 hour after delivery. If this period is exceeded, Farm will no longer have the obligation to replace the product. The cost of defective products is not refundable.

 

Payment

The user provides the consent that on the basis of the bank information originally entered, Farm shall be entitled to charge him/her at the beginning of each month, without subsequent consent of the user.

The user shall enter personal banking information directly on the website of the bank. Farm does not have an access to this information. Accordingly, Farm guarantees that it will not charge any amount from the user account other than the monthly subscription fee that the user initially agreed to.

 

Suspension of Subscription

The user is entitled to suspend the subscription and notify Farm at least 2 (two) working days before delivery of the product. In this case, the subscription fee will be charged in usual mode, and the undelivered products will be delivered to the user at the time and place agreed with him/her.

 

Unsubscribing

The user is entitled to unsubscribe by notification 1 (one) month before such cancellation. Regardless of the unsubscribing date, the delivery fee of the current month will be charged and the product will be delivered accordingly.

3. Privacy 

The user shall be responsible for accuracy of the information provided by him/her.

Farm is committed to protecting the confidentiality of personal information filled / provided by the user and not to transfer it to any third parties, other than the cases provided by the Laws.

Filling the personal information on the website of Farm is essential for identification of the users and delivery of the product. Farm is authorized to keep the information of the user for tax purposes during the following period: in case of a single order – during 3 (three) years after delivery of the order; in case of monthly subscription – during 3 (three) years after unsubscribing. Farm reserves the right to use the information provided by the users for remarketing. 

 

4. Copyright 

Any material available on this website, including photos, audio/video materials, images, design, trademarks (hereinafter – the “Materials”), is the intellectual property of Farm and is copyrighted.

Use of the Materials, without the prior written consent of Farm, is prohibited. No part of these Materials may be reproduced, reproduced, distributed, modified, transmitted, transferred, stored in any form or by any means.

It is not allowed to use the Materials in connection with any product or service, which may lead to confusion or/and discredit Farm or its affiliated companies.

 

5. Liability

Farm does not guarantee that its services or individual components thereof will be protected from computer viruses. For the purpose of protection against such risks, the user is entitled to take and implement individual prevention and protection measures. Farm shall not bear liability for any damage (loss) that may be caused by computer infection or any destructive elements of software while using the services.

By placing the order, the user represents that he/she is fully liable for any damage, loss and expense incurred to the directors, employees, shareholders and partners of Farm or its affiliated companies, if such damage, loss or expense occurs as a result of incomplete and improper fulfillment / use of the Terms and Conditions hereunder.

 

6. Regulatory legislation and venue of dispute resolution

Use of this website is regulated by all relevant legal acts of Georgia, taking the principles of conflict of interest into account, regardless of the type of dispute that arises between the user of the website and Farm or its affiliated company. 

Any dispute or complaint related to the website, sold/supplied product or services in any way, will be resolved by the court of Georgia.

 

7. Cookies

Cookies are small text files stored by the browser in your computer. These files allow websites to tailor content to the user. Cookies can be perceived as the memory of the website that guesses when you return and responds accordingly.

If you do not wish to receive cookies, you can select in the browser settings to receive notifications when cookies are sent, or you can refuse receiving of cookies at all. You can also delete already stored cookies.

 

Use of cookies

Google Analytics

Farm uses Google Analytics – a web analytics service provided by Google Inc. (Google), which applies cookies to analyze how a website is used to further improve your experience with the system of Farm.

This website will use so-called “User ID”. In Google Analytics, the User ID functions as the user nickname. Google links your online behavior and user ID to your profile. Google Analytics monitors your activity anonymously on a variety of devices (tablet, smartphone, etc.).

Google transmits and stores the information about use of the website by the user generated by Cookies (including your IP address) on the servers in the USA. Google will use this information to evaluate your use of the website, to report to us about website activity and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties when required by the Laws, or when third parties process information for Google. Google will not link your IP address with any other data in its database.

Google only accepts the user ID, without profile-containing information and other personal data. A short version of the created profile is available to us. We do not link your other personal information to the profile associated with the User ID.

You can also refuse using cookies by selecting the appropriate settings of your browser, but keep in mind that in this case you will not be able to use all the features of the website. By using this website, you provide the consent on processing of your data by Google in the manner and for the purposes as described above.

 

Facebook Pixel

The website of Farm uses “Facebook Pixel” feature of Facebook, directly linked to Facebook servers. The information about your visit to our website will be transferred this way to the Facebook server. Facebook will add this information to your user account if you have such an account on Facebook and you log in to it. If you visit other websites that also use “Facebook Custom Audience” / “Facebook Pixel” products, this information will be linked to your user account. But we do not know which other websites you visit. If you are not logged in to Facebook or you are not a Facebook user while visiting our website, the information about your visit to the websites will not be linked to your Facebook user account.
